We are not human all the way down: Submit your essay for the Biotechnology & Society essay contest

The Biotechnology & Society research group (BIOS) in the Department of Global Health & Social Medicine is accepting submissions for its second annual student essay contest.

Biotechnology & Society Essay Contest

Following the success of the launch of the BIOS essay competition in 2021, this year’s essays will answer the question:

"We all contain multitudes, we are inhabited by a vast non-human population that keeps us alive. We are not human all the way down. So what?"

The essay competition is open to all King’s students enrolled on undergraduate or taught postgraduate programmes, as well as recent graduates (2021/2022 cohort).

The deadline for submissions is Sunday 5th June 2022 at midnight.

First prize will win £600. Second prize will receive £300. Winners will be announced announced by the end of June 2022 with an online event chaired by the selection panel.

An excerpt of the winning essay will feature in the Global Health and Social Medicine newsletter and the essay will be published in full on the BIOS website.

How to apply

Your essay must be less than 3,000 words in length, should not use footnotes or endnotes, and should use Chicago or Harvard referencing style.

To submit your essay:

  • Prepare your essay for blind review, ensuring your name does not appear anywhere on the document or file name.
  • Send a separate application document with your full name, preferred email contact, enrolled programme and expected graduation date.
  • Send your essay and application document to [email protected] by Sunday 5 th June 2022 at midnight.

How the essays will be judged

The selection panel will consist of academics from King’s College London, chaired by Dr Sara Bea, Dr Silvia Camporesi and PhD candidate Jessica Tatchell. They will judge all essays on their originality and distinctive writing style .

Various interpretations of the essay question are welcomed and essays that do not directly answer the question but speak to its general themes will also be accepted.

Submissions can take the form of an academic essay or a more creative writing piece. Essays can be based on existing coursework however they must be adapted to address the themes in the above essay question. Read the winning essay from 2021 on the King’s website .

About the Biotechnology & Society research group (BIOS)

The BIOS research cluster investigates the social, ethical, and legal questions arising from emerging and digital (bio)technologies. The group brings together science and technology studies, medical sociology and anthropology, history of science and medicine with critical bioethics - and investigates how emerging biotechnologies and digital technologies are shaped and in turn shape the biopolitical landscape. Their research is markedly interdisciplinary in approach and informs public policy and global health governance.

Common Law and Equity have... merged or borrowed from each ‘

Other.. nothing more than incremental development by the, judges applying reasoning by analogy. the way they developed alongside, ’ each other is therefore nothing special, to what extent do you agree, introduction.

The statement above requires a critical analysis of two respects. Firstly, how far have these systems developed or merged together through solely case law and precedent. Secondly, what significance does this bear on the legal system and its participants.

I will argue the fusion of CL and equity was heavily and primarily progressed by statute as opposed to purely judicial precedent. Additionally, I will posit that the administration of common law (henceforth mentioned as CL) and equity are fused by the Judicature Acts 18731 , but the substantive laws themselves are not sufficiently integrated due to a difference in principles and terminology. The term ‘special’ will be interpreted as significant, as in suffi- ciently great and having an overall positive effect.

Origins of Equity

Although equity’s early history is obscure, evidence suggests that in the mid-fourteenth cen- tury the CL was becoming increasingly rigid and unsatisfactory. Equity was thus developed out of the inflexibility of the CL.

After the CL developed the writ system through the twelfth and thirteenth centuries it failed to develop further remedies. Unformalised agreements were prone to opportunistic ‘stick- lers’ 2 as known by Aristotle- people that insist on “taking what is indeed his share according to the law, even when the circumstances are such that sticking to the law on this point is a vice.” 3.

The universality of CL meant there was no room for leeway or variation within CL, leading to circumstances unintended by the legislator, Irit Samet notes the example of Mr Courtman 4 , who was one day late on payment of his mortgage. Without the advent of equity, he would be forced to forfeit the land to the mortgagor due to the CL strictly enforcing rules of ‘pay on the day agreed or lose the land’.

For these and other reasons, litigants petitioned the King’s Council to do justice. The King handed these petitions to the Chancellor who adjudicated these petitions not according to

The way that CL and equity have fused is special as it has significantly improved the conve- nience of the claimants and provision of appropriate remedies through integration of the ad- ministration.

An example of administration of both systems in the same court is the case of Walsh v Lons- dale 12 , the parties had agreed on a lease of a mill for seven years. Rent was payable quarterly in arrears but the landlord was entitled to a year’s rent in advance. However, the agreement was not formalised in a deed. When the landlord requested a year’s rent in arrears, the ten- ant refused to pay leading the landlord to bring a common claim for distress. The issue being whether the terms for a lease could be relied on. The court held equity could be applied here and the maxim ‘equity looks on that which ought to be done’ meant that as the parties had agreed on a lease, equity would consider this a good lease. The result of this trial would’ve been the same prior to the Judicature Acts 1873 13 but the claim would’ve had to been heard in two different courts. The CL court would have heard the distress claim whilst the Chancery would deal with the equitable principles. Now the same court can deal with both, thus ensuring that participants of the justice system are not deprived of remedy from an in- ability to pursue trials twice.

However, equity and CL have not fused substantively, this view is held by Ashburner who fa- mously said, “the two streams of jurisdiction, though they run in the same channel, run side by side and do not mix their waters.” 14. This truth is self evident towards all who closely ex- amine equitable and CL remedies.

The merger of CL and equity has not sufficiently harmonised monetary remedies between CL and equity. A. Burrows makes the argument that equitable compensation should be assessed with the same restrictions of remoteness as compensatory damages. The goal of ‘equitable compensation’ is to compensate a loss. It is to ‘put a claimant into as good a position as if no wrong had occurred’. It therefore has the same aim as compensatory damages, this is why there was no equitable compensation awarded in the case of Target Holdings Ltd v Redfern 15

  • because the loss in question would have been suffered even without the breach of duty by the defendants. The defendants breach of duty caused no loss and therefore there was noth- ing to compensate for.

However, there are those who consider that restrictions on compensatory damages such as remoteness, intervening cause and contributory negligence do not apply to equitable com- pensation. This is seen in Target Holdings v Redfern where Lord Browne-Wilkinson states “the CL rules of remoteness of damage and causation do not apply” 16. This lack of harmonisa- tion between the principles of CL and equity in assessing remedies leads to uncertainty within the law and potential variations in justice. I concur with Burrows that there is no good reason for equity going its own separate way when equitable compensation and com- pensatory share the same aim.

In conclusion, the development of equity and the CL has occurred through a combined effort of incremental development by reasoning by analogy and statute, with the latter being more integral in terms of creating the infrastructure by which the merger can stand on. This devel- opment has been special in significantly benefitting claimants to greater accessibility of ade-

quate remedies, but is nothing special in failings to harmonise the assessment of monetary remedies.
